Overview
What you will study
During the Law for Commercial Forensic Practitioners short course offered by University of Pretoria , you will gain knowledge and insights to the nature of criminal conduct, the legal mechanisms used to obtain evidence, and other issues that must be considered when witnesses or suspects are interviewed. The course also looks at how evidence obtained through more unconventional investigative techniques are admissible in court, which labour law pitfalls stand in the way of a successful disciplinary hearing and which reporting duties are activated in the course of such an investigation.
After completion of this course, delegates should:
- Be aware of the relevant legal principles.
- Be able to act within and to comply with the law.
- Be able to ensure that policies, procedures and actions comply with the law.
- Minimize the risk of the employers liability for unlawful actions.
Programme Structure
The program focuses on:- Legal issues in managing the risk relating to the appointment of personnel
- General principles of Criminal law
- Common law and statutory offences ( including fraud, theft, misappropriation of trade secrets, corruption, cyber-related crime and Money Laundering.)
- Law of evidence and constitutional rights
- The admissibility requirements for various types of evidence e.g. the warning of rights, dealing with privileges, ensuring the admissibility of the results of more invasive investigation techniques, such as, polygraphy, search and seizure, the interception of communications and entrapment in criminal, civil and disciplinary hearings
- Labour law issues
- The liability of an entity and/or its officials
- Remedies available to an entity, including the recovery of ill-gotten gains
- Dealing with Whistle-blowing in the workplace
