Bail and mitigation decisions have immediate and significant consequences for clients, and effective advocacy can make a decisive difference. This course equips you with the legal knowledge, case law, structure and advocacy techniques needed to make persuasive submissions in both the Magistrates’ and Youth Courts.

Through realistic scenarios and expert guidance, you’ll develop confidence in presenting bail applications, opposing remand and delivering clear, effective pleas in mitigation, strengthening your courtroom skills and advancing your criminal practice.

• Apply the statutory tests for adult bail and remand decisions, including exceptions and the “no significant risk of custody” test
• Use case law effectively when applying for bail or opposing applications
• Structure and deliver clear, persuasive bail applications and remand submissions
• Apply the latest Magistrates’ Court sentencing guidelines when preparing and delivering a plea in mitigation
• Use pre‑sentence reports effectively within mitigation advocacy
• Structure a plea in mitigation using recognised principles and techniques
• Address the court on the Principle of Legitimate Expectation when relevant
• Display confidence when seeking a specific sentence and supporting it with reasoned argument
